International Litigation

The commission „Debt Recovery Abroad“ has been founded in Oslo in the year 2000. It has been renamed in "International Litigation and Safer Export of Goods and Services" some years ago. Its purpose is to improve the flow of information among the members of Eurojuris International, each regional association thereof and the member firms. The working and discussion groups meet at least two times a year and focus on specific issues of international debt recovery. Each member writes reports about these issues in his\her jurisdiction that will be published here.

Welcome to the Cracow Conference 2008

As per our minutes of the last meeting of our group, we intend to study the following topics and do the following things in Krakow:

  • consideration of different limitation periods in the various jurisdictions
  • tort law / Deliktsrecht : an overview.  Including product liability and the effect of the Rome II Regulation
  • Short visit to the offices of Fiutowski, Buzowska & Partners, local member firm in Krakow, by kind invitation of Mr Benedyt Fiutowski.

Their foundation was the result of various meetings of group members on an informal basis that had been going on since 1998. One of these groups has organized a first meeting that took place in May 2000 in Paris. The result of this seminar was a publication comparing the statutory mechanisms of preliminary enforcement mechanisms in various countries (see below under article\publications). More seminars are coming up in the future (see below under news). Some members of the commission have been involved in the preparation of a code of civil procedure heading for general, EU-wide applicability others have been invited by the French government to take part in the hearings about the reform of judicial cooperation in Europe. The commission undertakes to improve the exchange of experience about debt recovery, enforcement and insolvency proceedings. Their work is heavily influenced by practical aspects. This way experiences are gathered and each member increases his\her knowledge, skill and success in international debt recovery.
